City of Markham Beats Fourth, Fifth, and Fourteenth Amendment Violation Complaint

Congratulations to our attorney Leslie Quade Kennedy for her win in the Heath, et al. v. Markham, et al., 19 C 40, case! Plaintiffs filed a 29-page second amended complaint alleging Fourth, Fifth and Fourteenth Amendment violations, criminal damage to property, a FOIA violation and Intentional Infliction of Emotional Distress against the City, Mayor, Police Department and numerous other Defendants after the City declared the plaintiffs’ property abandoned. Leslie filed a motion for dismissal, arguing that the Court lacked subject matter jurisdiction over the case and the Court agreed and granted Leslie’s motion.
